General conditions
“The Vrijewil” apartments uses the following general conditions. These are in force from the moment of reservation until the stay in our apartment.
General
- The vacation accommodation should be occupied between 3 p.m. – 9:30 p.m. on the day of arrival.
Tenants who do not (or cannot) arrive at the vacation address on time, are obliged to notify us in good time so that an arrangement can be made about receiving the key to the vacation accommodation.
- Costs additional to the rent must be agreed upon in advance between tenant and landlord and stated on the lease.
- Landlord is not liable for the consequences of theft, damage to Tenant’s property or accidents, all except in the event of fault on its part.
Landlord’s rights and duties
- Landlord undertakes to deliver the apartment to Tenant clean and in good condition at the agreed time. Tenant’s rights and obligations
- The tenant may not assign the rented property to third parties for rent or use, nor cause more persons to stay in it than agreed upon by contract.
- Tenant will occupy the leased property neatly and cleanly. Any damages that have occurred or previously noticed damages must be reported to the landlord. This also applies to loss of any part of the rented property, furnishings or household goods.
- Upon completion, Tenant shall deliver the apartment, with the inventory contained therein, clean and in good condition.
- Pets may be brought only with prior permission from the landlord.
- Pets are not allowed in the sleeping quarters and not on the furniture.
- No smoking is allowed in the apartment.
- The tenant is prohibited from causing noise pollution to the surrounding area, especially between 10 p.m. and 7 a.m., must be prevented.
Advance
- Upon final booking of the apartment, the tenant will pay the landlord an advance of up to 50% of the agreed rent. The deposit is an advance payment on the rent and will be deducted from the agreed rent at the time of settlement. The remaining amount of the rent will be paid within the stated period. – Landlord is not bound by this agreement until the advance payment has been received.
Cancellation provisions
“De Vrijewil” apartments is a VOF and a small company. Cancellations at relatively short notice have a major effect on the occupancy we try to achieve each year, as it is by no means a foregone conclusion that we can achieve alternative occupancy for the cancelled dates. To protect our business and revenue, we have established cancellation policies. However, we encourage you to contact us if you do need to cancel. In the unlikely event that you are prevented by circumstances on the dates you have booked, we have the following cancellation policy. If the tenant, for whatever reason, cancels a rental agreement, or without explicit cancellation does not or only partially uses his rights resulting from the agreement, he forfeits a compensation for the landlord. This compensation shall amount to: A) 30% of the rental price in case of cancellation 42 days before arrival.
- B) 60% of the rent if cancelled up to 28 days before arrival. C) 90% of the rent if cancelled up to 14 days before arrival.
- D) 100% of the rental fee for cancellation within 14 days before arrival or no-show.
We recommend that you purchase cancellation insurance.
Dissolution
Landlord is entitled to consider this contract dissolved without notice of default or court intervention will be required:
- If at the start of the rental period the full rental fee is not paid;
- If tenant leaves the leased premises early;
- If Tenant fails to properly comply with the obligation of this Agreement and/or the Rules of Order.
Without prejudice to the lessee’s liability for the full rental price in the cases mentioned under a, b and c, the lessor is obliged = in order to limit the damage incurred in the cases, to try to let the object to another person for the time during which it is not used by the lessee; the amount received on that account will be deducted from the rental owed by the lessee. This also applies if the tenant is prevented by personal or other circumstances from using the rented object.
